What are the prerequisites?
If you want to legally marry in Sydney, there are a few things you should know. The following are the initial requirements, according to the Attorney-General’s Department:
- The individual must be at least 18 years old (a court may approve if an individual is 16 to 18 years old but it is subject for approval).
- Both people should not be married to anyone else.
- The individual should not marry their sister, brother, grandfather, parent, child, or grandchild.
- The person should understand what marriage is, and you should give your consent to marrying the other person.
- The person who is legally bound to marry must use specific words during the marriage ceremony.
Within the time frame, a Notice of Intended Marriage should be given to the marriage celebrant, who is a person legally authorised to solemnise a wedding.
- The Notice of Intended Marriage
- You should give the completed form to the celebrant 18 months to a month before the wedding date.
- In some cases, a prescribed authority may be able to approve a wedding with less than a month's notice if you are getting married in less than a month.
- You must provide the celebrant with the following proof of identification, including your birthplace and date of birth, as well as any previous marriages. A completed statutory declaration may also be required.

- Original birth certificate or extract from the original birth certificate
- Original passport, either Australian or foreign
- If you were previously married, you must provide proof of divorce (divorce certificate or a Decree Absolute) or a death certificate.
- The celebrant will provide you with a statutory declaration to complete.
- The aforementioned Notice of Intention to Marry.

- In Australia, same-sex marriage is legal.
- Marriage celebrants can solemnise marriages in Sydney, whether civil or religious, as long as they are Commonwealth-registered.
- Even if you are not a citizen or permanent resident of Australia, you can marry here.
- On your wedding day, you and your partner must sign three marriage certificates, as must two witnesses and the celebrant. You will receive a duplicate of the certificate for your records.
- Within 14 days of your wedding, the celebrant will deliver your marriage paperwork to the registry of births, deaths, and marriages.
